Terms and conditions of sale

Preamble

BEEWINE is a company that develops and markets digital solutions for professionals. These solutions enable professional customers to easily create web pages presenting the new labeling information required for wines and spirits.

BEEWINE, whose registered office is located at 86 rue Pierre et Marie Curie, 34430 Saint Jean de Vedas, has a share capital of €1,200. It is registered with the Registre du Commerce et des Sociétés de Montpellier under number B 847 683 406. Its SIRET number is 84768340600015. The company is represented by Mr Renaud VENET, acting as Chairman.

1. Purpose

The general terms and conditions of sale described below detail the rights and obligations of BEEWINE and its Customer in the context of the latter’s subscription to INFOVINS services:

  • The design of web pages intended to present the new information required for wine and spirits labeling, as defined by the reform adopted in December 2021.
  • The creation of a separate QR code for each wine sheet.

All orders, whether placed by an individual or a legal entity and by various means such as telephone or website, automatically entail full and unreserved acceptance of these general terms and conditions of sale.

2. Services

By subscribing, the customer benefits from an offer enabling him to create as many wine files and QR Codes as necessary, provided that these files concern wines from the same company, or the same physical entity (opening an account for several companies is forbidden, and BEEWINE reserves the right to block or delete the account if such a case should arise, without entitling the customer to any reimbursement or compensation).

Once the offer has been added to the basket, the customer confirms the order by proceeding with payment, which can be made in a single instalment for one year or in 4 instalments, subject to validation of the file by Oney (see 5 Invoicing and payment terms). Once payment has been made, the customer receives an order confirmation by email, together with an invoice issued by BEEWINE. This invoice will be given to the customer upon delivery of the Services ordered.

The transaction will only be considered concluded once the total price has been paid in full. It is the customer’s responsibility to check the order accurately and to notify us of any errors immediately.

3. Awards

Fees for services offered must be paid in euros. Payment must be made at the time of ordering. Accepted methods of payment include online payment by credit card or bank transfer to BEEWINE’s account.

The stated prices remain invariable and are not subject to change during their period of validity. However, outside this period, BEEWINE retains the right to modify prices at its discretion and at any time.

4. Liability

Offered to all its customers, the service includes a review of the data supplied through the various cuvée addition forms available in customers’ personal spaces. This review is undertaken to ensure that the information declared is correctly positioned for optimal consultation by the end consumer.

With regard to the information in question, it is important to stress that BEEWINE cannot be held responsible for any incorrect or false information, whether deliberately or involuntarily declared by the customer. It is the customer’s responsibility to diligently verify the information he/she has declared.

BEEWINE cannot be held responsible for the suspension of services due to non-payment or non-compliance with the present contract.

The proper functioning of the INFOVINS interface is the responsibility of BEEWINE. However, the customer’s use of this interface is his or her own responsibility.

BEEWINE makes every effort to provide prompt service and maximum availability of this website. However, the site may be temporarily unavailable for maintenance. The Customer may not oppose BEEWINE in the event of temporary unavailability of its services, nor claim a refund or compensation in the event of temporary unavailability of its service.

5. Invoicing and payment terms

After validation of the order by the Customer, BEEWINE establishes and sends to the Customer the invoice for the subscription.

Payment of the price is made by secure payment using the following methods:

The customer is obliged to pay the full price in a single instalment at the time of ordering.

However, in cases where this option is offered on www.infovins.fr, the customer can choose to pay in installments with fees.

In the event of late payment, all sums due by the customer shall become immediately payable in full, without prejudice to any other action that the service provider may take against the customer in this situation.

6. Subscription, start, duration and end of contract

The contract is concluded for an indefinite period. It may be terminated at any time at the Customer’s or BEEWINE’s initiative.

Right of withdrawal: for individual customers or sole traders

In accordance with article L221-18 of the French Consumer Code, the right of withdrawal may be exercised within 14 days of payment of the order, by post or by e-mail to contact[at]infovins.fr, using the withdrawal form available at the bottom of the page, unambiguous, expressing the desire to withdraw.

The Service Provider’s postal address can be found in article 2 of these GCS.

If the right of withdrawal is exercised within the aforementioned period, only the price of the Services ordered will be reimbursed.

The sums actually paid by the Customer will be reimbursed within 14 days of receipt by the Service Provider of notification of the Customer’s withdrawal.

The current form must be duly completed only if the customer wishes to cancel the order placed with INFOVINS, except in cases where exclusions or limitations to the exercise of the right of withdrawal apply in accordance with the General Terms and Conditions of Sale in force.

Right of withdrawal: for professional customers

As the subject of the contract falls within the company’s main field of activity (being a service enabling compliance with a legal obligation for the marketing of its bottles of wine in France), the subscription to the service provided on infovins.fr does not give rise to a right of withdrawal for a contract concluded between professionals.

7. Force majeure

BEEWINE shall not be held liable if it fails to perform, or is late in performing, any of its obligations under these terms and conditions of sale due to a case of force majeure as usually recognized by jurisprudence.

9. Disputes

Any dispute arising from the interpretation or execution of these terms and conditions of sale shall be governed by French law. In the absence of an amicable solution, the dispute will be submitted to the jurisdiction of the Montpellier Commercial Court.
